California has no general law against being naked in public. The offence people usually have in mind, indecent exposure under Penal Code section 314, requires the exposure to be wilful and lewd — the California Supreme Court held in 1972 that someone simply sunbathing nude on an isolated beach is not committing it, because the statute requires sexual motivation. There is no state ban on female toplessness either.

What catches people out is local law, and this is the distinction that matters. Only the agency managing a piece of land can permit nudity on it, and in practice none has. State Parks regulation 14 CCR 4322 prohibits nudity in every state park except in authorised areas set aside for the purpose, and no such areas have ever been designated. The National Park Service states outright that it will not designate clothing-optional areas. So California has famous nude beaches and no legally designated one. Every well-known spot is tolerated by custom and thin enforcement, and tolerance can end without warning: San Gregorio, a long-established nude beach on the coast south of San Francisco, joined the state park system in July 2026 and nudity stopped being permitted.

San Francisco banned public nudity on streets in an ordinance passed in 2012 and in force since early 2013. Police Code section 154 covers streets, sidewalks, medians, parklets, plazas and transit vehicles and stops. It is an infraction, it does not require lewd intent, and officers may cite without a warning. Permitted parades, fairs and festivals are exempt, which is why nudity still appears at events like Bay to Breakers and the Folsom Street Fair. Note what the ordinance does not cover: female toplessness, and beaches. The north end of Baker Beach and neighbouring Marshall's Beach sit on federal land inside the Golden Gate National Recreation Area, where no federal regulation bans simple nudity and the Park Service's own page acknowledges the long tradition of visitors being undressed. That is tolerance of long standing, not a formal designation. Bonny Doon Beach near Santa Cruz is state parkland, so 14 CCR 4322 applies there and rangers can cite, despite decades of clothing-optional use.

Keep nudity and behaviour separate, because the law does. Being unclothed without sexual intent is one thing; sexual conduct in public is prosecuted separately and far more seriously. Nudity that is tolerated stops being tolerated the moment it looks sexual, is directed at anyone, or draws a complaint.
